User Agreement

1. The Role of Spriinkl

Spriinkl is a platform that allows Hosts to organize events. We are not the Host or sponsor of any event. Our role is limited to providing the technology. All events, prizes, and content are the sole responsibility of the event Host.

2. Sweepstakes and Prizes

If you participate in an event sweepstakes, you agree to abide by and comply with the Official Sweepstakes Rules, which are incorporated by reference into this Agreement. Key points include:

• By participating, you acknowledge that no purchase is necessary to enter or win, and a purchase does not improve your chances of winning.
• The Host is solely responsible for prize fulfillment and any associated tax reporting.
• Spriinkl does not provide, guarantee, or ship any prizes.
• Tax Notice for Winners: You are responsible for reporting ALL prize winnings as income on your tax returns, regardless of the value. No taxes will be withheld from your prize - you are responsible for reporting the value on your personal tax return. Please consult a tax professional with any questions about your tax obligations.
• No single participant can win both first and second prizes in the same event.

3. User Conduct

You agree to use Spriinkl responsibly. You will not:

• Post content that is illegal, hateful, defamatory, or pornographic.
• Harass, abuse, or harm another person.
• Use the platform for any commercial solicitation.
• Attempt to cheat or manipulate any sweepstakes or event activity.

We reserve the right to remove your content or suspend your access for violating these rules.

4. Your Content

You retain ownership of the content you post (e.g., guestbook messages, photos). However, by posting content, you grant the event Host and Spriinkl a license to display that content within the context of the event page.

5. Account Security

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

6. Limitation of Liability

By using Spriinkl, you release Spriinkl, its affiliates, and service providers from any liability, claims, or damages arising from your participation in an event, receipt of a prize (or failure to receive a prize), or interactions with a Host or other users. Your sole recourse for any issues related to an event lies with the event Host.

7. Governing Law and Dispute Resolution

Any dispute arising between you and an event Host relating to a specific event or sweepstakes is governed by the laws of the State of New York, without regard to its conflict of law provisions, except to the extent that the consumer protection laws of your state of residence apply notwithstanding this provision.

This Agreement and any dispute arising between you and Spriinkl shall be governed by the laws of the State of New York, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the state and federal courts located within New York County, New York for any claims you may have against Spriinkl.

8. Changes to this Agreement

We may modify this Agreement from time to time. Your continued use of the platform after any changes constitutes your acceptance of the new terms.
